A Retired Upper Shari'a Court Judge Rearrested and Granted Bail






A retired Upper Shari'a Court Judge has been rearrested and granted bail by a Magistrate Court sitting at Chediya GRA, Zaria. He faces charges of trespassing, use of force, and assaulting a blind housewife, contrary to Sections 327, 237, and 239 of the Penal Code Law of Kaduna State 2017.

Inspector Adamu Abubakar, the prosecuting officer, informed the Court that on September 6, 2024, one Garba Adda'u, a resident of Gonar Ganye Tudun Jukun, Zaria, filed a complaint at the Tudun Wada Divisional Police Office. Adda'u alleged that Mahmoud Shehu, the retired judge, locked their main gate, pursued his blind wife into her room, and assaulted her while two other women attempted to intervene.

The Prosecutor further stated that the assault resulted in the wife requiring medical attention at the Tudun Wada PHC.

When the Court questioned the defendant, Mahmoud Shehu, about the alleged offenses, he denied committing them.

Senior Magistrate Ibrahim Adamu Salisu granted bail on the following conditions:

 * A bail bond of N100,000.

 * Two sureties who must be civil servants on Grade Level 10 or above.

 * The sureties must submit their promotion letters to that level, along with their passports, full addresses, and phone numbers.

 * Failure to meet these bail conditions will result in Mahmoud Shehu being remanded at the Correctional Facility until the next hearing on February 11, 2025.

It is noteworthy that the case was initially filed on September 10, 2024, at the Magistrate Court Tudun Wada, Zaria. However, after several adjournments, the presiding judge, Senior Magistrate Lukman Sidi, withdrew from the case. It was subsequently transferred to Chief Magistrate Court 1, Chediya, for reassignment.
